Terms & Conditions

These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry and claim instructions are deemed to form part of the Terms and Conditions and by entering this promotion all participants will be deemed to have accepted and be bound by the Terms and Conditions. Please retain a copy for your information.

The Promoter takes data protection seriously. By entering in this promotion, you confirm that you have read the Privacy Policy and agree to these Terms and Conditions of the promotion. By submitting any information required as part of their participation into the promotion, participants agree to their information being held and processed in accordance with the General Data Protection Regulation (GDPR) and Data Protection Act 2018.

Eligibility
  1. The promotion is open to UK (England, Scotland, Wales and Northern Ireland), Isle of Man, Channel Island and Republic of Ireland residents aged 18+ only, excluding employees and their immediate families of LNCD UK, its affiliated companies, distributors, agents, and anyone professionally associated with this promotion.
  2. Purchase necessary. Please retain promotional pack and all receipts as proof of purchase.
  3. No purchase necessary mail-in route in Northern Ireland.
  4. Internet access required.
  5. Maximum 2 entries per person per day. Maximum 1 prize of each tier per person.
  6. Bulk entries made from trade, consumer groups, agents, third parties or syndicates will not be accepted. If it becomes apparent that a participant is using a computer(s) to circumvent this condition by, for example, the use of programme, application, script, brute force or any other automated means, that person’s entries will be disqualified, and any prize awarded will be void.
  7. Each entry to the prize draw must have a new pack and unique receipt as part of the entry requirements. Anyone trying to circumvent the rules stated in these Terms & Conditions by using alternative details will be disqualified from this promotion.

Entry Requirements
  1. For your chance of winning, purchase a promotional pack, while stocks last, retain the receipt and packaging.
  2. During the Promotion Period, Access [https://www.nestle-promotions.co.uk/chillednightin] and submit the last 4 digits of barcode from the Qualifying Purchase where indicated and complete your personal information as directed to participate in the instant win (Main Promotion Period only) and to enter the relevant weekly prize draw. Entrants will find out instantly on screen if they have won a Rakuten TV movie code or not, followed by confirmation that they have been entered into the relevant weekly prize draw
  3. Entrants into any late entry draws will be entered into their respective prize draw and will be notified, by email, within 5 days of the relevant closing date if they are a winner.
  4. Incomplete, illegible, misdirected or entries received outside any promotional period will not be accepted. Proof of sending will not be accepted as proof of delivery. The Promoter takes no responsibility for entries delayed, incomplete or lost due to technical reasons or otherwise.
  5. To enter without purchase in Northern Ireland only – send your name, age, full postal address and email address to: Nestlé Chilled Night In No purchase Necessary, Consumer Services, Nestle UK Ltd, York, YO91 1XY. Once the request has been verified, a promotional code will be provided via email, which can then be entered on the microsite in order to enter the winning moments and weekly prize draw. Your NPN (No Purchase Necessary) entry will be entered into the promotion with the same opportunity of winning as the purchase necessary route. NPN (No Purchase Necessary) Winners ONLY will be subsequently contacted by email in the first instance with details of how to claim the prize. Only one entry per stamped, correctly mailed envelope.   4. Instant Win:
    The Promoter has randomly allocated via an independently verified system a series of specific open winning moments equal to the number of instant win online prizes available during the Main Promotion. There are 9,000 instant win online prizes available for participants from the United Kingdom, Isle of Man and the Channel Islands and 300 available for participants from the Republic of Ireland. The person who submits their personal details on the microsite on or first after a specific winning moment will be the winner of that prize and will receive an on-screen message as set out above. Non-winning entrants will also receive an on-screen message advising them they were unsuccessful. If any instant win online prize remain unclaimed, the Promoter shall not be obliged to allocate that prize but may withdraw it from the promotion and use it as it sees fit.
  5. Prize Draws:
    1. Main Promotion, UK, IoM, CI: All valid entries received between 00:00:00 on a Monday and 23:59:59 on a Sunday during the Main Promotion Period will be submitted into a prize draw to win a Smart TV. One prize draw for each of the weeks of the Main Promotion Period.
    2. Main Promotion Period, ROI: All the valid entries received during the Main Promotion Period will be submitted into a prize draw to win the 1 Smart TV.
    3. Late Entry Promotions: All valid entries received during each Late Entry Promotion Period will be submitted into a prize draw.
Terms & Conditions for Tier 1 TV prizes
  1. There are a total of 9 x 55” Crystal UHD 4K HDR Smart TV’s to be won (8 for the UK, IoM & CI and one for ROI).
  2. Maximum 1x TV prize can be won in total per person throughout the promotional period.
  3. Prize Draws will be conducted from all valid entries each week throughout the main promotion (UK, IoM & CI), and one prize draw at the end of the full promotion (ROI), by or under the supervision of an independent entity. Reserves will be selected at the same time in each relevant draw in case they are needed Winners will be contacted within 5 days of the winner selection and will be asked to follow the instructions to verify their claim.
  4. Winners must fill out their address details and may be asked to provide their promotional pack and receipts for all entries within 14 days of receiving their win confirmation email or their prize will be forfeited.
  5. If a winner does not respond within this timeframe the Promoter can disqualify the winner and, for prize draw prizes, contact a reserve who will have the same notification and timeframe response requirements.
  6. The Promoter is under no obligation to award the prize if a first reserve is ineligible or fails to respond to the communication in a timely fashion, and if the first reserve refuses the Prize Draw Prize for whatever reason, the Promoter is not obliged to make further attempts to award the prize.
  7. Prizes are not transferrable and cannot be exchanged for cash. In the event of unforeseen circumstances, the Promoter reserves the right to substitute a Prize for an alternative of equal or greater value.
  8. A winner may be required to participate in publicity arising from the promotion, though for regulatory reasons if the winner is or looks under 25 such publicity will not include photographs of the winner.
  9. For all TV winners, prizes will be sent via courier. Winners will be contacted to organise delivery and ensure someone is present to receive the prize. Please allow 28 days for receipt of prize after claim and verification.
  10. Once receipt of delivery has been confirmed, Nestlé will no longer be liable for any damages to the prizes.
Terms & Conditions for Tier 2 Rakuten TV movie code (rentals) prizes
  1. There are a total of 10,000 movie codes for rentals [worth up to €/£4.99] available to be won (UK/ROI: 9,600 for the UK, IoM & CI and 400 for ROI).
  2. Maximum 1x movie code prize can be won in total per person.
  3. The Promoter has allocated a series of specific winning moments equal to the number of instant win online prizes available during the Main Promotion.
  4. The person who submits their personal details on the microsite on or first after a specific winning moment will be the winner of that prize and will receive an on-screen message as set out above. Non-winning entrants will also receive an on-screen message advising them they were unsuccessful. How to claim prizes
  1. Winners of the movie codes will receive instructions on screen and via email about how to claim their prize. Winners of the 4K Smart TV will receive instructions on how to claim their prize via email.

  4. Rakuten TV movie code T&C’s:
    1. The voucher code is usable for a movie rental in SD, HD up to €/£4.99
    2. You can watch any of the movies available after clicking on "Redeem your voucher" and putting in the code when prompted.
    3. Renting a movie gives you the right to watch it for up to 48 hours after redeeming the voucher.
    4. The codes are valid until 30.09.2021.

    6. Vouchers are not for resale.
    7. The codes from this promotion cannot be combined with each other or with any other promotional codes or other promotions
General
  1. The Promoter’s decision is final with regard to all promotional matters.
  2. Proof of entry is not proof of purchase. Responsibility cannot be accepted for entries that are lost, damaged or delayed, nor any associated costs to entrants.
  3. Winners will be subject to a full verification process. Winners may be asked to provide their promotional pack and receipt for each entry as proof of purchase in order to verify their claim.
  4. All entrants will be required to provide a genuine email address that is personal, valid and accessible throughout the promotion. In the event that the specified information is not provided or is incorrect or an alias, the entry may be considered incomplete and therefore the Promoter reserves the right to invalidate the entry.
  5. In the event of an email address becoming inaccessible during the promotion, the Promoter is not able to retrieve and amend any existing entries to a new email address.
  6. Limitations of liability: Neither the Promoter, its agents or anyone professionally connected to the promotion, assume any responsibility or liability for:
    1. Any incorrect or inaccurate barcode entry, or for any faulty, erroneous or failed electronic data transmissions.
    2. Any unauthorised access to, or theft, destruction or alteration of barcodes at any point in the operation of this promotion. Communications line failure, regardless of cause, with regards to any equipment, systems, networks, lines, satellites, servers, computers or providers utilised in any aspect of this promotion;
    3. Inaccessibility or unavailability of the internet or the microsite or any combination thereof;
    4. Any unauthorised access to, or theft, destruction or alteration of codes at any point during the operation of this promotion.
  7. Conduct of entry: The Promoter reserves the right at its sole discretion to disqualify any entrant found to be tampering with the entry process or the operation of the promotion; or to be acting in any manner deemed by the Promoter to be in violation of the Terms and Conditions; or to be acting in any manner deemed by the Promoter to be disruptive.
  8. If, for any reason, any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter may in its sole discretion modify or suspend the promotion or invalidate any affected entries. If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation but will always endeavour to minimise the effect to participants in order to avoid undue disappointment.
  9. The Promoter reserves the right to verify all entries including but not limited to asking for address and identity details (which they must provide within 14 calendar days) and to refuse to award a prize or withdraw prize entitlement, and/or refuse further participation in the promotion and disqualify the participant where there are reasonable grounds to believe there has been a breach of these Terms and Conditions or any instructions forming part of this promotion’s entry requirements or otherwise, where a participant has gained unfair advantage in participating in the promotion or won using fraudulent means. The Promoter will be the final arbiter for all decisions, which are final and binding. It will not respond to any correspondence.
  10. By taking part in the promotion, winners agree that Nestlé may contact them to ask whether they want to participate in marketing activities relating to the promotion.
  11. Subject to the Promoters Privacy Policy winners of both the TV and movie codes surnames’ and counties’ will be available by sending an email request to consumer.services@uk.nestle.com with ‘WINNERS LIST: ‘Chilled night in’ in the subject line, for a period of 3 months following the end of the main promotion period. When contacting this email address, your request will be actioned in line with the Nestlé Privacy Policy. If any winner objects to their information being published, then they can contact the Promoter by emailing UKI.dataprotection@uk.nestle.com with the subject line ‘Chilled Night In promotion’.
  12. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using the prize, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.
  13. By taking part in the promotion, entrants acknowledge that they may be required to take part in relevant reasonable publicity without further payment. Such publicity may include, without limitation, the entrants name and/or if consent given, image or statements made by the entrants concerning the promotion and/or prizes obtained as part of the promotion.
  14. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.
  15. The Promotion and these Terms and Conditions will be governed by the laws of the participating country but any disputes as to the meaning of these terms will be subject to the exclusive jurisdiction of the participant’s local courts.

  1. The Promoter will only use the personal details supplied for the administration of the promotion and the auditing of the entries where necessary and for no other purpose, unless we have your consent/you have opted-in to receive future marketing communications. The surnames and counties of verified winners will be made available as set out in Clause 52 above and winners can object to this by emailing UKI.Dataprotection@uk.nestle.com. Otherwise, your personal details will at all times be kept confidential and in accordance with the General Data Protection Regulation (GDPR) and the Data Protection Act 2018 as applicable.
