Full Terms & Conditions

These Terms and Conditions (the “Terms and Conditions”) prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry and claim instructions are deemed to form part of these Terms and Conditions and by participating all participants will be deemed to have accepted and be bound by them. Please retain a copy for your information.

The Promoter takes data protection seriously. By entering this promotion, you confirm that you have read the Privacy Policy found here: https://www.nestle.co.uk/en-gb/privacypolicy and agree to these Terms and Conditions of the promotion. By submitting any information required as part of their participation in the promotion, participants agree to their information being held and processed in accordance with the General Data Protection Regulation (GDPR) and the Data Protection Act 2018.

Eligibility

  1. The promotion is open to Sainsbury’s shoppers who are residents of Great Britain (England, Scotland, and Wales), aged 18 or over only.
  2. Employees of the Promoter or J Sainsbury, their immediate families, their affiliates, agencies, or anyone else professionally connected with this promotion are not eligible to enter the promotion.
  3. Purchase required. Please retain original winning Quality Street® tub, the original winning insert found within the Quality Street® tub and receipt or details relating to receipt of the tub as proof of purchase as they will be required for the claim process.
  4. Proof of eligibility may be required.
  5. Telephone required for claim process. Nectar membership required to claim prize.

Promotional Period

  1. This Quality Street® ‘BECOME A NECTAR MILLIONAIRE’ promotion is open until POS Units displaying the promotion are exhausted in participating J Sainsbury outlets.
  2. Due to the nature of the promotion (i.e., which involves the finding of the ‘Golden Nectar Insert in a Quality Street® tub which are limited in number), and the independent random distribution of these Golden Nectar inserts, all of the 5 Quality Street® tubs may be purchased before the end of the promotional period.

How to Enter

  1. To enter, participants must purchase a participating 550g Quality Street® tub from participating stores across Sainsbury’s supermarkets displaying the promotion, subject to stock availability. See Appendix I for the list of participating stores.
  2. Winners will find out instantly on opening a tub if they have won by finding a Golden Nectar Insert within their 550g Quality Street® tub. The original winning Golden Nectar Insert contains details to claim your prize. Fake or copied Golden Nectar Insert or Insert/labels pretending to be a winning card will not be entertained.
  3. The winning Golden Nectar Insert have been inserted into randomly selected 550g Quality Street® tubs which are then distributed at random in J Sainsbury stores displaying the point of sale and thus participating in the promotion.
  4. The randomisation and seeding process has been carried out by an independently verified process and through an independent auditor.

The Prize

  1. There are 5 “Nectar millionaire” prizes available to be won throughout the promotional period. Each prize is the equivalent of £5,000 which will be transferred to the winners Nectar account as 1,000,000 Nectar points after successful verification.
  2. If your purchased tub does not include a winning insert and a Golden Nectar Insert, then unfortunately you are not a winner.

Winner Verification

  1. During the promotion, winners will find out instantly, on opening the tub if they have won by finding their tub is filled with The Purple One® chocolate and a Golden Nectar Insert. The winning insert will contain details on how to claim the 1,000,000 Nectar points. The Golden Nectar Insert must be retained, as well as the winning special Quality Street® tub and proof of purchase details. The participating pack containing The Purple One®’s can be eaten following verification.
  2. Winners should call the winner’s freephone telephone number featured on the winning insert for further information on how to claim their prize.
  3. Winners should retain the Golden Nectar Insert, the Quality Street® tub, plus proof of purchase or the details relating to the receipt of the tub to claim the prize.
  4. Winners must contact the winners’ hotline by 30.09.26 failing which they will forfeit their prize.
  5. Winners will be required, as part of the claim process, to securely provide the Promoter with their full address, proof of ID and Golden Nectar Insert plus information relating to the location of purchase and the actual proof of purchase details/information for verification.
  6. Photocopies of the original winning insert will not be accepted, and the Promoter cannot accept any responsibility for any winning insert found on receipt by the Promoter to be damaged or defaced so that claim verification is not possible.
  7. Winners should however take a photocopy or photograph of the winning insert on both sides together with their proof of purchase details /gift information for their own reference.
  8. The original winning insert and proof of purchase details /information must be received by the Promoter via the method mentioned on the call within 28 days of the winner contacting the Promoter in accordance with the prize redemption instructions discussed.
  9. Prize redemption will be subject to a full verification process by an independent third party. The Promoter shall be entitled to disregard any invalid, incomplete, un-substantiated, fraudulent entries, or those which are otherwise not in accordance with these Terms and Conditions, and to disqualify the entrant from the Promotion.
  10. If a selected winner is ineligible, in breach of these rules/Terms and Conditions, or unable to take up the prize for any other reason, the prize will be forfeited. The Promoter cannot be held responsible for winners failing to supply accurate information which affects prize acceptance or delivery.

Prize Fulfilment

  1. On verification of the prize redemption being valid, the winner will be contacted by the Promoter for award of the prize. A current valid Nectar membership will be required to claim the prize.
  2. The prize will be transferred to the winner’s Nectar membership account within 28 working days of the winning entry being verified by the Promoter.

General

  1. The Promoter accepts no responsibility for failure to receive an entry where such failure is due to circumstances outside the Promoter’s control.
  2. By entering, entrants agree to accept and be bound by these Terms and Conditions. If there is any reason to believe that there has been a breach of these Terms and Conditions, the Promoter may at its sole discretion refuse to accept an entry and/or disqualify an entrant or a winner.
  3. Incomplete, illegible, corrupted entries, or those which are otherwise not in accordance with these Terms and Conditions will not be valid.
  4. Proof of sending is not proof of receipt. Responsibility cannot be accepted for any winning insert, proof of purchase details/information, or prize redemption documentation that is lost, damaged, mislaid or delayed, nor any associated costs to entrants.
  5. Prizes are non-transferable and must be transferred to the winners Nectar membership account. Nectar membership is free, and an account can be set up via the website https://www.nectar.com/id/start/nectar-card-check. No alternative to a prize will be offered, except when the Promoter reserves the right to offer an alternative prize of equal or greater value than the original or vary these Terms and Conditions due to any unforeseen circumstances beyond our control.
  6. In the event of circumstances beyond the control of the Promoter, or in cases of fraud, abuse and/or error (human or compute) that affects or could affect the proper operation of the promotion or the awarding of prizes, and only when the circumstances are unavoidable, the Promoter reserves the right to cancel or modify the Promotion or these Terms and Conditions at any time but will always endeavour to minimize the impact on the participant in order to avoid undue disappointment.
  7. The Promoter reserves the right to conduct audits on all entries and winners, refuse a prize, withdraw an award or to refuse further participation into the Promotion where there are reasonable grounds to believe that there has been a violation of these Terms and Conditions, an entrant had an unfair advantage in participating in the Promotion or where or an entrant has won by fraudulent means.
  8. The Promoter reserves the right to add more prizes into the main promotion. Winners only will be notified in line with these Terms and Conditions.
  9. Winners may be asked if they consent to take part in reasonable publicity relating to this promotion without further remuneration. They are not obliged to do so.
  10. Limitations of liability: insofar as permitted by law, neither the Promoter nor the promotional parties assume any responsibility or liability for: -
    1. Any incorrect or inaccurate winner’s data transmissions.
    2. Any unauthorised access to, or theft, destruction or alteration of winner’s codes at any point in the operation of this promotion;
    3. Communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilised in any aspect of this promotion;
    4. Insofar as permitted by law, any damage, loss or injury suffered due to entering this promotion or taking up a prize.
  11. The Promoter will only use the personal details supplied for the administration of the promotion and the auditing of the entries where necessary and for no other purpose.
  12. The Promoter’s decision is binding in all matters relating to this promotion.
  13. A list of the Nestlé Quality Street® Nectar Millionaire winners’ surnames and their counties will be available by posting your request to consumer.services@uk.nestle.com and using the subject line “WINNERS LIST: Nestlé Quality Street® Nectar Millionaire ” within 3 months of the promotion closing. The promoter reserves the right to refuse any or all such requests. Should a Nestlé Quality Street® Nectar Millionaire winner object to their information being made available, they should contact the Promoter by emailing UKI.dataprotection@uk.nestle.com with the subject line ‘Nestlé Quality Street® Nectar Millionaire’. The promoter may nevertheless disclose the information to the relevant Advertising Standards Authority if required to do so.
  14. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.
  15. To the fullest extent permitted by law the Promoter excludes any and all liability for any loss, damage or injury occurring to you or any third party arising from your entry into the promotion.
  16. These Terms and Conditions (and any non-contractual disputes/claims which arise out of or in connection with them) will be governed by the relevant local courts who shall have exclusive jurisdiction over any and all disputes arising out of, relating to or concerning these Terms.

Data Protection

  1. The Promoter will only use the personal details supplied for the administration of the promotion and the auditing of the entries where necessary and for no other purpose, unless we have your consent, and you have opted-in to receive future marketing communications. The surnames and counties of verified winners will be made available as set out in the appropriate clause above and the winners can object to this by emailing UKI.Dataprotection@uk.nestle.com. Otherwise, your personal details will at all times be kept confidential, and in accordance with Data Protection Act 2018. Click here for the Promoter’s Privacy Policy . You can request access to your personal data, or have any inaccuracies rectified, or request deletion of data by sending an email to UKI.Dataprotection@uk.nestle.com. By participating in the promotion, you agree to the use of your personal data as described here. You can withdraw your consent at any time. For the purpose of the promotion, requests to delete personal data can only be actioned after the promotion has concluded. Any data obtained via this promotion will be deleted 3 months after the promotional period with the exception of the winners and reserves whose data will be deleted after fulfilment of the prize.
