These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry/claim instructions are deemed to form part of the Terms and Conditions and by participating all entrants will be deemed to have accepted and be bound by the Terms and Conditions. Please retain a copy for your information.

The Promoter takes data protection seriously. By entering in this promotion, you confirm that you have read the Privacy Policy, and agree to these Terms and Conditions of the promotion. By submitting any information required as part of their participation into the campaign, participants agree to their information being held and processed in accordance with the General Data Protection Regulation (GDPR).

Eligibility:

  1. The promotion is open to UK (England, Scotland, Wales and Northern Ireland), Isle of Man, Channel Island and Republic of Ireland residents aged 18+ only and excludes employees and the immediate families of Nestlé UK Ltd (“the Promoter”), its affiliated companies, agents or anyone professionally connected to the promotion.
  2. Internet access required.
  3. Purchase required (No Purchase Necessary available for Northern Ireland residents). Please retain promotional pack including code as proof of purchase.
  4. There is no limit on the number of entries permitted to the promotion, however, participants can only win a maximum of two (2) times during the Main Promotional Period and Late Entry Draws combined. Each entry must have a new unique promotional pack including code.
  5. Conduct of entry: The Promoter reserves the right at its sole discretion to disqualify any entrant found to be tampering with the code redemption process or the operation of the promotion; or to be acting in any manner deemed by the Promoter to be in violation of the Terms and Conditions; or to be acting in any manner deemed by the Promoter to be disruptive.
  6. Anyone trying to circumvent the rules stated in these Terms & Conditions by using alternative details will be disqualified from this promotion.
  7. Bulk entries made from trade, consumer groups, agents, third parties or syndicates will not be accepted. If it becomes apparent that a participant is using a computer(s) to circumvent this condition by, for example, the use of programme, application, script, brute force or any other automated means, that person’s entries will be disqualified and any code or prize awarded will be void.

Promotional Period:

  1. Main Promotional Period is from 10am to 10pm each day from 06.05.19 to 28.07.19 with one thousand (1,000) winning moments each hour. Entries outside these daily start and finish times will not be accepted into the main promotion.
  2. After the main promotional period there will still be the opportunity to enter for the Late Entry draws. Entries are only valid for one draw. Those entries received between 00:00 on 29.07.19 and 23:59 on 31.08.19 will be included in the draw that closes at 23:59 on 31.08.19. Entries received between 00:00 on 01.09.19 and 23:59 on 30.09.19 will be included in the draw that closes at 23:59 on 30.09.19. Entries received between 00:00 on 01.10.19 and 23:59 on 30.11.19 will be included in the draw that closes at 23:59 on 30.11.19. Entries received between 00:00 on 01.12.19 and 23:59 on 30.06.20 will be included in the final draw that closes at 23:59 on 30.06.20. Entries will not roll over between the draws.

How to enter:

  1. To enter participants must:
    • Purchase a participating promotional pack (see clause 19 for participating products);
    • Visit www.nestle-promotions.co.uk/nowtv
    • Enter their full name, genuine email address and the 12-character unique promotional code found inside promotional packs
    • Select their County and either UK (includes Channel Islands and Isle of Man) or ROI as country of residence
    • Find out instantly online if they are a winner (Main Promotion Period only)
    • Winning entrants (Main Promotional Period only) will be notified on screen and via a confirmation email.
    • The on screen message and confirmation email will contain instructions on how to redeem. Winning entrants must login or register with NOW TV to redeem. To register, winning entrants must enter their full name, email address, postal address, and a valid debit or credit card. The discount will be automatically applied if the user has followed the URL hyperlink provided. Winners will also be sent an email to the address provided upon entry with a link allowing them to return to the selection process at a later date.

  2. All NOW TV passes must be redeemed through a NOW TV account by 23:59 on 01.08.2020.
  3. NOW TV account set up with debit/credit card required, however, users will not be charged on this occasion. Entering these details are subject to NOW TV’s Privacy Policy which can be found here. Please note: Address information and debit/credit card information will not be requested on the Nestlé promotional website, any websites appearing to be linked to the promotion (with the exception of NOW TV) that request address and debit/credit card information are not official Nestlé websites.
  4. The monthly pass will, however, be automatically renewed at the end of the month at its then standard price unless cancelled (price as at 28.01.19: £7.99/€15.00).
  5. To cancel a pass, and avoid additional charges, please follow these instructions:
    • Go to www.nowtv.com and log in to your account
    • Go to 'My Account' in the menu bar
    • Select 'Passes & vouchers' or 'My Passes' if you're an ROI customer
    • Select 'Cancel Pass' next to the Entertainment Month Pass, then follow the steps.

    You will be able to keep watching until the date your payment was due.

  6. Not available in conjunction with any other Entertainment Pass offer. In order to apply a free pass, existing NOW TV customers who are currently using another Entertainment Pass voucher offer will need to wait until their current voucher has less than 30 days remaining before being able to apply their free pass.
  7. When a free pass is applied to an existing NOW TV account within the timeframes specified in clauses 11 and 15, the reoccurring charge will not be charged in the free month. This applies where the account holder has an existing Entertainment Pass active on their account.
  8. Promotional codes and NOW TV voucher codes can only be used once and by the genuine winner only. Entrants who do not give correct details or those who make an entry on someone else’s behalf will be disqualified.
  9. To enter without purchase in Northern Ireland only – applicants for a no purchase entry are required to send their name, age, full postal address and email address to: WIN a NOW TV Pass Promotion NPN, Consumer Services, Nestlé UK Ltd, Haxby Road, York, YO91 1XY. Once the request has been verified, a promotional code will be provided via email, which can then be entered on the microsite in order to enter the promotion. Only one entry per stamped, correctly mailed envelope. A maximum of three (3) entries per person, per day. Bulk entries or entries sent through trade, consumer groups, agents, syndicates or third parties will not be accepted. No purchase necessary applications must be received by the Promoter no later than 31.05.20 to ensure that requests can be processed before the final closing date.

    This applies when the pack features the ‘NOW TV – 1,000 Entertainment Passes to win every hour’ promotional flash, and while stocks last.

Prizes:

  1. Total of 1,008,000 NOW TV passes have been randomly allocated via winning moments during the promotional period. One thousand (1,000) chances to win every hour each day from 10am – 10pm instantly throughout the Main Promotional Period. So a total of 12,000 available each day. An additional two thousand (2,000) prizes are available to be won in each late entry draw.
  2. Each prize consists of a one (1) month NOW TV Entertainment pass.
  3. Passes will be activated immediately once an account has been set up and the code has been redeemed through NOW TV. Passes are valid for a period of one (1) calendar month from the date of activation. You will be able to check the expiry date of your pass through your NOW TV account.
  4. All passes must be redeemed with NOW TV by 23:59 on 01.08.2020.
  5. A maximum of two (2) passes can be won in total per person throughout the core & late entry periods.

How to claim your NOW TV pass:

  1. 25. Winners will be informed online immediately after submitting their entry if they have won (Main Promotional Period only – see clause 9 for details of the Late Entry draws). The winner will then need to follow the below claim process on the microsite:

    • Enter payment & contact details and redeem pass
    • A NOW TV code will be automatically applied to your account and will autorenew unless cancelled. See Clauses 13-16 above.

    Payment will not be taken for the pass, please ensure NOW TV code has been automatically input. NOW TV account set up with debit/credit card required.

  2. In the event that the Winner does not wish to claim their NOW TV pass immediately after being notified of their win, they will also be sent an automatic email which includes a link to allow claim of the NOW TV pass at a later date. All NOW TV passes must be redeemed via the Winner’s NOW TV account by 23:59 on 01.08.2020.
  3. All Winners from the Main Promotional Period & Late Entry draws are subject to verification.

Winner selection and notification:

  1. During the Main Promotional Period, prizes have been randomly allocated and linked to ‘winning moments’ that have been randomly pre-selected by a secure, independently verified computer programme. There are one thousand (1,000) winning moments available every hour from 10am to 10pm throughout the Main Promotional Period. The first person to enter a unique promotional code on or after the allocated winning moment will have been deemed to have won. All prizes are available to be won. During the Main Promotional Period, winners will be notified online immediately after entry and will also be sent a confirmation email to confirm their win. Winners must then follow the on-screen instructions in order to claim their prize (see clause 25 for full details).
  2. In the event that any winner is disqualified from the promotion, the Promoter reserves the right to withdraw the prize and reallocate their prize to the first available Late Entry draw.
  3. Four Late Entry draws will follow the Main Promotional Period, with 2,000 prizes to be won in each draw (8,000 in total). The random draws will be conducted by an independently verified computerised system. The winners of the Late Entry draws will be notified via email within 10 working days of the relevant draw and will be required to follow the instructions to complete their prize claim. Winners must redeem their NOW TV Entertainment pass through their NOW TV account by 23:59 on 01.08.2020. Failure to respond in this manner may result in the winner being disqualified and the prize forfeited.
  4. Any prize left unclaimed after 23:59 on 01.08.2020 will be deemed void.

General:

  1. Winners will be subject to a full verification process. Winners may be asked to provide their promotional pack with the unique code and proof of purchase in order to verify their claim.
  2. Proof of sending is not proof of purchase. Responsibility cannot be accepted for any requested claims that are lost, damaged or delayed, nor any associated costs to entrants.
  3. All entrants will be required to provide a genuine email address that is personal, valid and accessible throughout the promotion. In the event that the specified information is not provided or isincorrect, the entry may be considered incomplete and therefore the Promoter reserves the right to invalidate the entry.
  4. Entries made from additional email accounts will not be accepted. If it becomes apparent that an entrant (person) is using an alternate or alias email account(s) in addition to their own as a means to circumvent this condition that person’s entries will be subsequently disqualified and any prize awarded, or in the process of being awarded, will be void.
  5. In the event of an email address becoming inaccessible during the promotion, the Promoter is not able to retrieve and amend any existing entries to a new email address.
  6. All prizes are non-transferrable, non-negotiable and non-refundable. No cash alternative is offered in whole or in part and the Promoter reserves the right to substitute any part of the prize for an item of equal or greater value due to circumstances outside of the Promoter's control should any element of the prize be unavailable. Unless otherwise agreed in writing by the Promoter, the prize will only be awarded directly to the winner.
  7. Promotional codes must be entered online exactly as they appear in the pack. Each promotional code is unique and can only be used once. Attempts to enter the same promotional code or NOW TV code more than once, the use of codes from non-promotional packs, or the use of any promotional codes not intended for use in this promotion, may result in disqualification and all entries will be declared void.
  8. The promotional codes have no value and cannot be transferred or sold.
  9. In ROI this promotion is carried out under the licence issued to Down Syndrome Ireland, Unit 3, Park Way House, Western Parkway Business Park, Ballymount Drive, Dublin.
  10. Limitations of liability: Neither the Promoter, its agents or anyone professionally connected to the promotion, assume any responsibility or liability for:
    • Any incorrect or inaccurate code entry, or for any faulty, erroneous or failed electronic data transmissions;
    • Any unauthorised access to, or theft, destruction or alteration of codes at any point in the operation of this promotion. Communications line failure, regardless of cause, with regards to any equipment, systems, networks, lines, satellites, servers, computers or providers utilised in any aspect of this promotion;
    • Inaccessibility or unavailability of the internet or the microsite or any combination thereof;
  11. The Promoter reserves the right to verify all entries including but not limited to asking for the pack and relevant code, address and identity details (which they must provide within 14 days) and to refuse to award a prize or withdraw a prize entitlement and/or refuse further participation in the promotion and disqualify the participant where there are reasonable grounds to believe there has been a breach of these Terms and Conditions or any entry requirements or otherwise where a participant has gained unfair advantage in participating in the promotion or won using fraudulent means.
  12. The Promoter and its partners reserve the right to terminate an active pass from a users NOW TV account if there is reason to believe that the pass was acquired via fraudulent means.
  13. To the extent permitted by law, the Promoter cannot accept any responsibility for any damage, loss, or injury suffered by any entrant as a result of entering the promotion or accepting the prize or any injury or damage to the entrant's or any other person's computer or mobile telephone relating to or resulting from participation in or downloading any materials in connection with the promotion.
  14. By taking part in the promotion, winners agree that Nestlé may contact them to ask whether they wish to participate in marketing activities relating to the promotion.
  15. The Promoter's decision is final and binding in all promotional matters.
  16. The Promoter does not assume any responsibility for promotional codes damaged or defaced in the way the product packaging is opened. If you cannot read your promotional code due to a genuine printing error, you should contact Nestlé Consumer Services either by email at consumer.services@UK.nestle.com or by telephone on Freephone 00800 6378 5385 (UK /IoM or CI + ROI) and a replacement code will be sent to you. Any request for a replacement code must be received by 31.05.20 to ensure that the request can be processed before the final closing date.
  17. In the event of exceptional circumstances outside its reasonable control or otherwise where fraud, abuse, and/or an error (human or computer) affects or could affect the proper operation of this promotion or the awarding of prizes, and only where circumstances make this unavoidable, the Promoter reserves the right to cancel or amend the promotion or these Terms and Conditions at any stage but will always endeavour to minimize the effect to participants in order to avoid undue disappointment.
  18. Subject to Nestlé's Privacy Policy, the surnames and counties of verified winners will be available upon request by sending an email to consumer.services@uk.nestle.com with the subject line 'WINNERS LIST: NOW TV promotion' for a period of 3 months following the end of the promotion. If any winner objects to their information being published, then they can contact us by emailing UKI.Dataprotection@uk.nestle.com
  19. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.
  20. Data Protection: The Promoter will only use the personal details supplied for the administration of the promotion and the auditing of the entries where necessary and for no other purpose, unless we have your consent/you have opted-in to receive future marketing communications. The surnames and counties of verified winners will be made available as set out in Clause 50 above and winners can object to this by emailing UKI.Dataprotection@uk.nestle.com. Otherwise, your personal details will at all times be kept confidential and in accordance with the General Data Protection Regulation (GDPR) as applicable.
