Terms & Conditions

These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry / claim instructions are deemed to form part of the Terms and Conditions and by entering this promotion all participants will be deemed to have accepted and be bound by the Terms and Conditions. Please retain a copy for your information.

The Promoter takes data protection seriously. By entering in this promotion, you confirm that you have read the Privacy Policy and agree to these Terms and Conditions of the promotion. By submitting any information required as part of their participation into the promotion, participants agree to their information being held and processed in accordance with the General Data Protection Regulation (GDPR) and the Data Protection Act 2018.

Promoter: Nestlé UK Ltd, Nestlé Confectionery (UK), York, YO91 1XY.

  1. This promotion is only open to residents of the United Kingdom (England, Scotland, Wales & Northern Ireland) aged 18 or over.
  2. The promotion excludes employees of Tesco Stores Ltd, Nestlé UK Ltd, their immediate families, affiliated companies, agents, or anyone professionally connected with this promotion.
  3. Purchase (no purchase necessary in NI) and internet access are necessary to enter the promotion. Please retain your promotional packaging and itemised receipt as it may be required for claim purposes.
  4. There is no limit on the number of entries permitted to the promotion, however, participants must have a new unique promotional pack and associated receipt for each qualifying entry. There is a maximum of one prize per household.
  5. Conduct of entry: The Promoter reserves the right at its sole discretion to disqualify any entrant found to be tampering with the entry process or the operation of the promotion; or to be acting in any manner deemed by the Promoter to be in violation of the Terms and Conditions; or to be acting in any manner deemed by the Promoter to be disruptive.
  6. Anyone trying to circumvent the rules stated in these Terms & Conditions by using alternative details will be disqualified from this promotion.
  7. Bulk entries made from trade, consumer groups, agents, third parties or syndicates will not be accepted. If it becomes apparent that a participant is using a computer(s) to circumvent this condition by, for example, the use of programme, application, script, brute force or any other automated means, that person’s entries will be disqualified, and any prize awarded will be void.
Promotional Period:
  1. The promotion will run from 00.00 on 16.09.19 until 23.59 on 19.11.19. Entries outside of these dates and times will not be accepted into the Prize Draw.
  1. There are 215 prizes available to be won in total throughout the promotional period. Prizes are as follows:
    • 5 x European holiday breaks for 2 people
    • 10 x Movie night-in bundles
    • 200 x Entertainment pass bundles
  2. The 5 x European holiday breaks are worth up to £2,000 each and also include £250 spending money (awarded as a cheque, made payable to the winner of the promotion). The Prize destinations available to choose from are:
    • Prague, Czech Republic
    • Rome, Italy
    • Greece (winner to select from choice of 5 locations within Greece)
    • Paris, France
    • Côte D’Azur, France
  3. The holidays are valid for travel until December 2020 excluding dates as specified in the relevant prize, listed below. These exclusions include: Christmas (22.12.19-05.01.20), Easter (10.04.20-13.04.20) and all UK Bank Holidays (08.05.20, 25.05.20 & 31.08.20).
  4. All holiday prizes are based on holidays for 2 people sharing a twin or double room. Options include: 2 adults or 1 adult and 1 child.
  5. The Prize winner and their travelling guest are responsible for: any and all costs, expenses and taxes not expressly described herein including, without limitation, ground transportation, gratuities, merchandise, telephone calls, personal expenses of any nature for overnight layover, meals and beverages, service charges and entertainment; costs incurred to and from the departure point as the Prize originates and terminates there.
  6. All prizes must be accepted as awarded and may not be refunded if unused. No cash or other alternatives are available in whole or in part, except in the event of circumstances outside of its control, the Promoter thereby reserves the right to substitute similar alternatives of equal or greater value. Unless otherwise agreed with the Promoter, a winner is not permitted to transfer the right to take up a prize to anyone else. No substitutions, changes or extensions to the prize are permitted.

How to Enter:
  1. To enter participants must:
    1. Purchase a participating promotional pack whilst stocks last (see clause 19 for participating products) within a participating Tesco Extra or Express store.
    2. Visit www.nestle-promotions.co.uk/wintesco
    3. Enter their full name, email address, county and the last 4 digits of their barcode found on the back of the pack and the retailer from which their pack was purchased to enter the promotion.
    4. Once all the required details are entered you will receive an instant message on screen to confirm you have entered.
    5. The winners will be drawn at random from all valid entries received during the promotional period.
  2. Promotional products include:
    These products apply only when the pack features the ‘Win a [Sky Store] Movie. 50,000 to be won’ promotional flash, and while stocks last.
  3. To enter without purchase in Northern Ireland only – send your name, age, full postal address and email address to: Nestlé Sky Store Tesco NPN, Consumer Services, Nestlé UK Ltd, Haxby Road, York, YO91 1XY. Once the request has been verified, a 4 digit code will be provided via email, which can then be entered on the microsite in order to enter the promotion and be entered into the prize draw. Only one entry per stamped, correctly mailed envelope. No Purchase Necessary applications must be received by the Promoter no later than 12.11.19 to ensure that requests can be processed for the main promotion. Any applications received after this date will not be processed. Maximum of one (1) No Purchase Necessary entry per person.
  4. No purchase necessary requests will be subject to verification.
Winner selection & notification:
  1. All valid entries received during the promotional period will be entered into the prize draw.
  2. A total of 215 winners will be randomly drawn in order by prize type and verified from all genuine, valid entries by an independent third party on 20.11.19.
  3. The three prize types to be drawn in order are:
    • 5 x European holiday breaks for 2 people
    • 10 x Movie night-in bundles
    • 200 x Entertainment pass bundles
  4. The winners will be notified via the email used to enter the promotion within 7 days of the draw taking place, giving instructions for the next steps of the claim process. The Promoter will request the potential winners of the 5 x holiday prizes to provide the Promoter, in a secure manner, information including: their name, telephone number, proof of age and address and other details to assist with verification, fulfilling the claim and arranging the prize fulfilment. Inaccurate information may result in the prize being forfeited. All winners should retain their notification email message until their win has been verified.
  5. For all other prizes, potential winners may be required to submit further details (including their address details) in a secure manner for prize verification and claim.
  6. The Promoter will make all reasonable efforts to contact the winners, however, if any winner has not responded to notification within 28 days, or if the winner is ineligible, otherwise in breach of these Terms and Conditions, or unable to take up the prize for any other reason, the Promoter reserves the right to forfeit the original prize and to select the reserve next in line for the relevant prize from the original draw.

Prize Redemption and Fulfilment:
    Holiday Prizes
  1. Travel dates are subject to availability. Travel will be subject to flight and hotel availability at the date of booking the trip. The prize winner must notify the fulfilment agency at least six weeks in advance of his/her preferred location and dates for taking the flights.
  2. The winner must complete their travel by 31st December 2020. Extensions to the validity of the prize will not be allowed unless first authorised by the Promoter.
  3. The Promoter or fulfilment agency accept no responsibility for any elements within the prize or booked through the fulfilment agency at the winner’s expense being withdrawn or amended. In the event of this, the fulfilment agency will endeavour to offer a suitable alternative.
  4. All travel arrangements offered are at the discretion of the Promoter and fulfilment agency.
  5. Any amendments wished to be made by the prize winner after the booking is confirmed are subject to the discretion of the Promoter and may be subject to administration charges levied by the specific supplier.
  6. The prize winners and their party (where applicable) are responsible for and must comply with any health advice/regulations/inoculations required by any destination country. Any associated costs for this are the responsibility of the prize winner and their party (where applicable).
  7. The winners and their guests must not have any limitations upon their ability or rights to travel to and from both the experience / prize destination and the departing country. The right to refuse entry to either country is held by Passport control and countries authorities. The Promoter and Prize Partners accept no responsibility for ensuring the Winner or their guests are able to travel and are not responsible for any costs incurred should entry be refused by Passport control or the countries authorities.
  8. Health insurance is provided by the fulfilment agency for winners up to the age of 79 with no pre-existing medical conditions.
  9. All health insurance policies are dealt with on a case by case basis, and varies depending on age of winner and holiday destination chosen.
  10. The winners and their guests take full responsibility for any risks associated with traveling to, in and from the prize destination or departing country. The Promoter will (with the Winners and guests) take into account any travel advice from the UK Government to ascertain whether there are any issues with potential travel and will try and assist with suitable alternatives should there be major concerns. The promoter or The Prize Partner can provide advice and recommendations, however they are not responsible for any loss or damage suffered by the Winner and/or travellers in relation to this promotion, the exercise of the prize.
  11. The potential winners are subject to verification of eligibility and compliance with these Terms and Conditions and could still post qualification be disqualified as the Promoter reserves the right to verify that the winner and guests will meet necessary standards and not cause the brand embarrassment by the individual or their guest. Part of this process may include questions during the claim process and a review of personal information sourced from data available in the public domain.
  12. The prize winners will be responsible for any other incidentals on the trip and in the hotel and will be required to give credit card details on check in.
  13. The prize winner’s guest must be over the age of 18 years, except where the winner is the parent or legal guardian of the accompanying guest.
  14. Prize winners and their guest must all be in possession of a full, current and valid passport and will be solely responsible for attaining any required visas, vaccinations or travel permits.
  15. The £250.00 spending money will be sent to the winner by cheque for payment into their personal UK bank account via Royal Mail or Courier within 14 days of their win being verified by the Promoter. If the winner does not have a bank account, the Promoter will use reasonable endeavours to find an alternative method to provide the prize funds.

  17. Movie Night In Bundles
  18. For the movie night in bundles, once verified, the Promoter will arrange delivery of the winner’s prize at a time/date that is convenient for the winner.
  19. Winners will have 28 days to respond to their initial notification email in order to claim their prize. If a winner does not respond within 28 days, their win will be forfeited and their prize will be deemed void.
  20. Entertainment Pass Bundles
  21. For the entertainment pass bundles, once verified, the Promoter will provide the 3 x codes securely within an email to the winner using the email address provided when entering the promotion.
  22. All NOW TV passes must be redeemed through a NOW TV account by 23:59 on 31.03.20.
  23. Login with NOW TV or register with NOW TV at www.nowtv.com in order to redeem;
  24. Newly registered NOW TV accounts require set up with a debit/credit card, however, users will not be charged on this occasion. Entering these details are subject to NOW TV's Privacy Policy which can be found here. Please note: Address information and debit/credit card information will not be requested on the Nestlé promotional website, any websites appearing to be linked to the promotion (with the exception of NOW TV) that request address and debit/credit card information are not official Nestlé websites.
  25. Winners will need to select the relevant pass and enter the corresponding code supplied to them in their winners email. The code will be applied to their account and will autorenew unless cancelled. Please see below for further details.
  26. Payment will not be taken for the pass, please ensure the relevant NOW TV code has been entered correctly.
  27. The monthly passes will, however, be automatically renewed at the end of the month at their then standard price unless cancelled (price as at 16.09.19: NOW TV Entertainment pass £8.99; NOW TV Kids pass £3.99; Hayu pass £3.99).
  28. When a free pass is applied to an existing NOW TV account within the timeframes specified in clauses 48 and 57, the reoccurring charge will not be charged in the free month. This applies where the account holder has an existing Entertainment, Kids or Hayu Pass active on their account.
  29. A compatible device and Broadband/3G/4G access is required to stream Entertainment, Kids and Hayu channels via NOW TV (charges may apply).   30. To cancel a pass, and avoid additional charges through auto renewal, please follow these instructions:
    1. Go to www.nowtv.com and log in to your account
    2. Go to 'My Account' in the menu bar
    3. Select 'Passes & vouchers'
    4. Select 'Cancel Pass' next to the relevant Month Pass, then follow the steps.
    You will be able to keep watching until the date your payment was due.
  31. Not available in conjunction with any other Entertainment Pass, Kids Pass or Hayu Pass offer. In order to apply a free pass, existing NOW TV customers who are currently using another Entertainment Pass voucher offer will need to wait until their current voucher has less than 30 days remaining before being able to apply their free pass.
  32. NOW TV voucher codes can only be used once and by the genuine winner only. Entrants who do not give correct details or those who make an entry on someone else's behalf will be disqualified.
  1. Winners will be subject to a full verification process. Winners may be asked to provide their promotional pack and itemised receipt (or all packs and itemised receipts if multiple entries) as proof of purchase in order to verify their claim.
  2. Proof of sending is not proof of purchase. Responsibility cannot be accepted for any requested claims that are lost, damaged or delayed, nor any associated costs to entrants. Barcodes must be legible and untampered to be accepted.
  3. All entrants will be required to provide one genuine email address only that is personal, valid and accessible throughout the promotion. In the event that the specified information is not provided or is incorrect, the entry may be considered incomplete and therefore the Promoter reserves the right to invalidate the entry.
  4. Entries made from additional email accounts will not be accepted. If it becomes apparent that an entrant (person) is using an alternate or alias email account(s) in addition to their own as a means to circumvent this condition that person’s entries will be subsequently disqualified and any prize awarded, or in the process of being awarded, will be void.
  5. In the event of a genuine email address becoming inaccessible during the promotion, the Promoter is not able to retrieve and amend any existing entries to a new email address.
  6. The barcodes have no value and cannot be transferred or sold.
  7. Limitations of liability: Neither the Promoter, its agents or anyone professionally connected to the promotion, assume any responsibility or liability for:
    1. Any incorrect or inaccurate code entry, or for any faulty, erroneous or failed electronic data transmissions;
    2. Any unauthorised access to, or theft, destruction or alteration of codes at any point in the operation of this promotion. Communications line failure, regardless of cause, with regards to any equipment, systems, networks, lines, satellites, servers, computers or providers utilised in any aspect of this promotion;
    3. Inaccessibility or unavailability of the internet or the microsite or any combination thereof;
  8. The Promoter reserves the right to verify all entries including but not limited to asking for the receipt and relevant barcode from the pack, email address and identity details including address (which they must provide within (28 days) and to refuse to award a prize or withdraw a prize entitlement and/or refuse further participation in the promotion and disqualify the participant where there are reasonable grounds to believe there has been a breach of these Terms and Conditions or any entry requirements or otherwise where a participant has gained unfair advantage in participating in the promotion or won using fraudulent means.
  9. To the extent permitted by law, the Promoter cannot accept any responsibility for any damage, loss, or injury suffered by any entrant as a result of entering the promotion or accepting the prize or any injury or damage to the entrant's or any other person's computer or mobile telephone relating to or resulting from participation in or downloading any materials in connection with the promotion.
  10. By taking part in the promotion, winners agree that Nestlé may contact them to ask whether they want to participate in marketing activities relating to the promotion.
  11. Subject to Nestlé’s Privacy Policy, the surnames and counties of the verified prize winners will be available upon request by sending an email to consumer.services@UK.nestle.com with the subject line ‘WINNERS LIST: Sky Store Tesco Exclusive promotion’ for a period of 3 months following the end of the promotion. If any winner objects to their information being published, then they can contact us by emailing UKI.Dataprotection@uk.nestle.com with the title ‘SKY STORE TESCO PROMOTION.’
  12. The Promoter's decision is final and binding in all promotional matters.
  13. The Promoter does not assume any responsibility for promotional barcodes damaged or defaced in the way the product packaging is opened.
  14. In the event of exceptional circumstances outside its reasonable control or otherwise where fraud, abuse, and/or an error (human or computer) affects or could affect the proper operation of this promotion or the fulfilment of the prize, and only where circumstances make this unavoidable, the Promoter reserves the right to cancel or amend the promotion or these Terms and Conditions at any stage but will always endeavour to minimise the effect to participants in order to avoid undue disappointment
  15. The Promotion and these Terms and Conditions will be governed by the laws of England. The courts of England and Wales will have exclusive jurisdiction over any and all disputes arising out of, relating to, or concerning these Terms and Conditions.
  16. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.
  17. Data Protection: The Promoter will only use the personal details supplied for the administration of the promotion and the auditing of the entries where necessary and for no other purpose, unless we have your consent/you have opted-in to receive future marketing communications. Otherwise, your personal details will at all times be kept confidential and in accordance with the General Data Protection Regulation (GDPR) and the Data Protection Act 2018.
