Terms & Conditions

These Terms & Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry /claim instructions are deemed to form part of the Terms & Conditions and by entering this promotion all participants will be deemed to have accepted and be bound by the Terms & Conditions. Please retain a copy for your information.

The Promoter takes data protection seriously. By entering in this promotion, you confirm that you have read the Privacy Policy, and agree to these Terms & Conditions of the promotion. By submitting any information required as part of their participation into the campaign, participants agree to their information being held and processed in accordance with the General Data Protection Regulation (GDPR) and Data Protection Act 2018.

Eligibility

  1. The promotion is open to UK (England, Scotland, Wales and Northern Ireland), Isle of Man, Channel Island and Republic of Ireland residents aged 18+ only and excludes employees and the immediate families of Nestlé UK Ltd (“the Promoter”), its affiliated companies, agents or anyone else professionally connected to the promotion.
  2. Internet access required.
  3. Purchase necessary. Please retain promotional pack(s) and receipt(s) as proof of purchase.
  4. No Purchase Necessary mail in option in NI.
  5. Maximum two (2) entries per person per day and maximum of one (1) prize tier/person & maximum of one (1) prize tier/household. For clarification and avoidance of doubt a prize tier is either 1x top tier prize: Staycation worth up to €/£1,500; or 1 x second tier prize: Day Out worth up to €/£100. A maximum of one of each of these can be won by a person or a maximum of one of each of these can be won by a household only during the promotional period
  6. Bulk entries made from trade, consumer groups, agents, third parties or syndicates will not be accepted. If it becomes apparent that a participant is using a computer(s) to circumvent this or any other condition by, for example, the use of programme, application, script, brute force or any other automated means, that person’s claim(s) will be disqualified, and any prize awarded will be void.
  7. Each entry to the promotion must have a new pack and unique receipt as part of the entry requirements. Anyone trying to circumvent these rules stated in the Terms & Conditions by using alternative details will be disqualified from this promotion

Promotional Period

  1. The core promotion will run between 00:00 03.05.21 – midnight 27.06.21.
  2. After the core promotional period, there will still be an opportunity to win 1x Staycation or one of the 10x Days Out prizes in each of the two late entry draws:
    1. The first late entry draw period will run between 00:00 on 28.06.21 and midnight on 19.09.21.
    2. The second late entry draw period will run between 00:00 on 20.09.21 and midnight on 03.05.22.
  1. Entries during the core promotion, depending on times will be accepted into the relevant daily promotional draws detailed. Entries are valid for the applicable draw only and will not roll over.

    Each promotional day will run from 00:00 to midnight throughout the promotional period.

    After the core promotion participants will only be allowed to enter into a late entry draw. No instant win online will be available. Entries are valid for the applicable draw only and will not roll over.
  1. Entries received after the closing dates of the late entry draws will not be accepted into the relevant promotion draws detailed.

Entry Requirements

  1. Within this promotion there are two prize tiers available to be won from entries received during the core promotion – prizes available via daily prize draws and prizes available via online instant win.
  2. To enter the promotion for a chance to win one of the top tier prizes, consisting of a Staycation worth up to €/£1,500, in a daily prize draw participants must:
    1. Purchase a participating promotional pack of Nestlé singles whilst stocks last (see clause 19 for participating products);
    2. Visit www.nestle-promotions.co.uk/staycation or scan the QR code on the back of selected packs to be taken directly to the promotional microsite
    3. Enter their full name, email address, county & country of residence and the last 4 digits of the barcode found on the back of the promotional pack to be entered into a prize draw to win a Staycation:
      1. Entrants into the core promotion will be entered into that day’s prize draw and be notified, by email, the next working day if they are a winner
      2. Entrants into any late entry draws will be entered into their respective late entry prize draw and will be notified, by email, within 2 weeks of the closing date if they are a winner.
  3. Upon entering the promotion during the core promotional period only, entrants will also have an opportunity to win one of the second tier prizes, consisting of a Day Out worth up to €/£100. They will win one second tier prize by successfully entering on or first after the time that the prize has been randomly allocated to an open winning moment and they will be notified on screen instantly if they have won. Non winners will also be notified. All winners will be asked to follow the instructions on screen for verification and to claim their Day Out prize. Winners will also be sent a confirmation email to the address provided on entry.
  4. Please retain your promotional pack containing the barcode and itemised receipt for each entry as you will require these for verification purposes.
  5. Each receipt can only be used once. Entrants who do not give correct details, provide inaccurate or the wrong or incorrectly dated receipts or those who make an entry on someone else’s behalf will be disqualified.
  6. Incomplete, illegible, misdirected or entries received outside any promotional period will not be accepted. Proof of sending will not be accepted as proof of delivery. The Promoter takes no responsibility for entries delayed, incomplete or lost due to technical reasons or otherwise.
  7. To enter without purchase in Northern Ireland only – send your name, age, full postal address and email address to: Nestlé Staycation Promotion NPN, Consumer Services, Nestlé UK Ltd, Haxby Road, York, YO91 1XY. Once the request has been verified, a 4-digit promotional code will be provided via email within 2 working days, which can then be entered on the microsite in order to enter the promotion. Only one entry per stamped, correctly mailed envelope. A maximum of 2 claims permitted per person throughout the promotion period. No Purchase Necessary applications must be received by the Promoter no later than 25.04.22. Only applications received by 20.06.21 will be processed before the end of the core promotional period. Applications received between 21.06.21 – 13.09.21 will be entered into the first late entry draw. Applications received between 14.09.21 – 25.04.22 will be entered into the final late entry draw.

Prize Details

Top tier: Staycation worth up to £/€1,500

    • Glamping Staycation – (multiple locations to choose from) 4 night glamping staycation for 4; self-catering basis; breakfast hamper included.
    • Coastal Staycation – (multiple locations to choose from) 2 night stay for 4; twin or double rooms; daily breakfast included; local attraction or dining experience included.
    • City Sightseeing Staycation – (multiple locations to choose from) 2 night stay for 4; twin or double rooms; daily breakfast included; local attraction or dining experience included; 4 x 24 hour hop-on, hop-off sightseeing bus ticket included.
    Please note, travel insurance is not included within the Staycation prizes.

    Due to the choice and specifics of the staycation options available and the ongoing COVID-19 pandemic it is not possible to feature all the elements associated with each Staycation prize but the third party operator will be able to give you more comprehensive details based on the most up to date information before the winner decides on the choice of their Staycation prize package once the win has been confirmed.
  4. All winners will receive a travel allowance of €/£200 to be spent on travel necessary for their chosen staycation. Eligible winners will be given further instructions on how to claim their travel allowance, once they have successfully passed verification checks. The travel allowance will be issued either via Paypal, Money Order, BACS transfer or cheque. Depending on the method of payment chosen by the winner, details such as a valid postal address and/or email address may be required.
  5. As a standard, each Staycation prize is for 4 people (4x 18+ adults or 2x 18+ adults & 2x children). However, some prizes may be feasible for parties of 2 or 6. This will be reviewed on a case by case basis if queried by the winner. In instances where the prize cannot be amended within the dedicated £/€1,500 allowance (inc. €/£200 travel allowance), the winner will need to cover any and all additional costs.
  6. T&Cs specific to the chosen venue may apply. These will be provided to the winner prior to prize being awarded.
  7. All Staycations are subject to availability and certain dates may be excluded, for example Christmas Day. All staycation prizes won in the core promotional period and within the first late entry draw must be booked and taken by 30th November 2022. Staycation prizes won within the final late entry draw must be booked and taken by 30th June 2023. After the time periods stated above, the prize will become invalid.
  8. In the event that government restrictions and guidelines related to the COVID-19 pandemic prohibit a winner from fulfilling their Staycation prize on the confirmed date, the prize will be re-arranged for an alternative date.
  9. The prize will be booked on behalf of the winner by a third-party operator. The third-party operator will confirm all details and email confirmation of the prize to the winner.
  10. The fulfilment of each Staycation prize will be managed by a dedicated third-party operator acting on behalf of Nestlé.
  11. No refunds or cash will be provided if the Staycation prize is deemed to be worth less than €/£1,500.

Second tier: €/£100 Days Out

  1. Total of 201 x Days Out to be won between 03.05.21 –27.06.21 via randomly allocated open winning moments.
  2. Entrants into the core promotion who successfully enter on or first after the randomly allocated open winning moment will be awarded a Day Out prize.
  3. The following list details the Days Out prize options available to choose from in the UK or ROI:
    • Aquariums (based on 2 adults & 2 children)
    • Historical Sites (based on 4 people; no age restrictions apply)
    • Treetop Adventure (please note, minimum height & weight restrictions apply; based on 2 adults & 2 children)

  4. Each Day Out prize is for between 2-4 people (adults/children) depending on the prize chosen from the list of available options.

Winner selection and notification

  1. Winners of the daily Staycation prize draws will be randomly selected by a secure, independently verified computer programme from all valid entries on the day.
  2. Daily draws during the week (Monday to Thursday) will be drawn the next working day. Friday and any weekend draws will be drawn the following working day, Monday or in the case of Bank Holidays on a Monday, on the Tuesday after the Bank Holiday.
  3. All winners will be notified within 24 hrs of the relevant draw date to the email provided on entry.
  4. Please retain winning communication until any prize has been verified.
  5. Winners will be subject to a full verification process. Winners will be required to provide their promotional pack with the barcode and also the relevant proof of purchase in order to verify their claim. If the winner has entered multiple times, the Promoter reserved the right to request receipt proof of all of the entries.
  6. In the event that any winner is ineligible, does not claim their prize within the stated claim period or is disqualified from the promotion or if any prize is not claimed, the Promoter reserves the right to withdraw their prize and include it in the final late entry draw.
  7. Within the core promotional period, Staycation prize draw winners only will be notified of their win via the email provided on entry, to confirm the claim process. Winners will have 14 days to claim their prize. There will be a request for further information such as proof of ID, address and phone number, together with the purchased promotional pack details and proof of purchase as detailed above. Once verified by an independent third party. The prize operator will contact the winner via email in order to book their chosen Staycation.
  8. 1 x Staycation winner and 10x Days Out winners will be drawn in each late entry draw and winners only will be contacted via the email provided on entry within 2 weeks of each of the late entry draws closing dates. Winners from the late entry draws will receive an email containing a link to submit further information including their address in order to verify the claim. Any unclaimed prizes from the core promotional period will be drawn in the final late entry draw.
    1. 1x First late entry period: 00:00 28.06.21 - 23:59 on 19.09.21.
    2. 1x Final late entry  period: 00:00 on 20.09.21 - 23:59 on 03.05.22.
  9. For the Days Out prizes, there are 201 Days Out to be won throughout the duration of the promotion. The prizes will be won via open winning moments randomly selected and distributed via computer programme where winners will be successful if they enter on or first after the winning moment when a prize is available. If no entry is received between any winning moments, then the prize will be rolled over to the next winning moment and be available to be won then.
  10. Throughout the duration of the promotion the Days Out online prize winners only will be notified immediately on screen and will be asked to immediately submit further information including their address in order to verify the claim. If you cannot complete the form immediately, a winning email containing a link to submit this additional information will also be sent to the email address that the winner provided on entry within 24 hrs if they win Monday to Thursday and the next working day if they win between Friday or Sunday, or on a Bank Holiday. Once verified by an independent third party the prize operator will contact the winner via email in order to book their Day Out.
  11. No guarantee all prizes will be won during the core promotional period. Any remaining prizes not won or any prizes that remain unclaimed following the close of the main promotional period will be re-allocated to the final late entry draw.
  12. All winners will first have to be verified, following receipt of information. Once verified they will then be contacted by a third-party operator to redeem their prize and book their Staycation or Day Out.

  14. All winners from the core promotional period (03.05.21 – 27.06.21) & first late entry draw (06.21 – 19.09.21) will have until 30th November 2022 to take their prize. All winners from the final late entry draw (20.09.21 – 03.05.22) will have until 30.06.23 to take their prize.

General

  1. The Promoter’s decision is final with regard to all promotional matters.
  2. Any and all costs incurred by obtaining time off from work or study to take part in the promotion or promotional prize are the responsibility of the winner. The Promoter accepts no responsibility for costs incurred.
  3. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using the prize, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.
  4. All entrants will be required to provide a genuine email address that is personal, valid and accessible throughout the promotion. In the event that the specified information is not provided or is incorrect or an alias, the entry may be considered incomplete and therefore the Promoter reserves the right to invalidate the entry.
  5. In the event of an email address becoming inaccessible during the promotion, the Promoter is not able to retrieve and amend any existing entries to a new email address.
  6. Last 4 digits of the barcodes must be entered online exactly as they appear on the pack. Each barcode that is entered on the promotional microsite must be a separate purchase with a corresponding itemised receipt in order for the entry to be valid. Please retain for any prize claim.
  7. Barcodes have no value and cannot be transferred or sold.
  8. In ROI this promotion is carried out under the license issued to Jack and Jill Foundation, Johnstown Manor, Johnstown, Naas, Co Kildare.
  9. Limitations of liability: Neither the Promoter, its agents or anyone professionally connected to the promotion, assume any responsibility or liability for:
    1. Any incorrect or inaccurate barcode or data entry, or for any faulty, erroneous or failed electronic data transmissions;
    2. Any unauthorised access to, or theft, destruction or alteration of barcodes at any point in the operation of this promotion. Communications line failure, regardless of cause, with regards to any equipment, systems, networks, lines, satellites, servers, computers or providers utilised in any aspect of this promotion;
    3. Inaccessibility or unavailability of the internet or the microsite or any combination thereof;
    4. Any unauthorised access to, or theft, destruction or alteration of barcodes at any point during the operation of this promotion;
    5. Any damage, injury or loss of earnings incurred directly or indirectly in relation to this promotion.
  10. Conduct of entry: The Promoter reserves the right at its sole discretion to disqualify any entrant found to be tampering with the code redemption process or the operation of the promotion; or to be acting in any manner deemed by the Promoter to be in violation of the Terms & Conditions; or to be acting in any manner deemed by the Promoter to be disruptive.
  11. Prizes are not transferable or exchangeable unless otherwise stated and cannot be redeemed for cash or any other form of compensation. In the event for any reason the user does not take any element of the prize at the time stipulated by the Promoter, then that element of the prize will be forfeited by the user and neither cash nor any other form of compensation will be supplied in lieu of that element of the prize, unless otherwise agreed. If, due to unforeseen circumstances, the prize is not available, the Promoter reserves the right to substitute another prize for it, in its sole discretion, of equal or higher value. Unless otherwise agreed in writing by the Promoter, the prize will only be awarded directly to the participant.
  12. If, for any reason, any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, the Promoter may in its sole discretion modify or suspend the competition or invalidate any affected entries. If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms and Conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation but will always endeavour to minimise the effect to participants in order to avoid undue disappointment.
  13. The Promoter reserves the right to refuse to award a prize or withdraw prize entitlement, and/or refuse further participation in the promotion and disqualify the participant where there are reasonable grounds to believe there has been a breach of these Terms and Conditions or any instructions forming part of this promotion’s entry requirements or otherwise, where a participant has gained unfair advantage in participating in the promotion or won using fraudulent means. The Promoter will be the final arbiter for all decisions, which are final and binding. It will not respond to any correspondence.
  14. By taking part in the promotion, winners agree that Nestlé may contact them to ask whether they want to participate in reasonable marketing activities and publicity relating to the promotion. Such publicity may include, without limitation, the entrants name and/or if consent given, image or statements made by the entrants concerning the promotion and/or prizes obtained as part of the promotion. Winners are not obliged to agree to any request.
  15. Subject to Nestle’s Privacy Policy, the surnames and counties of verified winners of the Staycation and Days Out prizes will be available upon request by sending an email request to services@uk.nestle.com with the subject line ‘WINNERS LIST: WIN a Staycation Promotion’, for a period of 3 months following the end of the promotion. When contacting this email address, your request will be actioned in line with Nestlé’s Privacy Policy. The Promoter reserves the right to refuse any or all such requests. If any winner objects to their information being published, then they can contact the Promoter by emailing UKI.Dataprotection@uk.nestle.com with the subject line ‘Win a Staycation promotion’. We may nevertheless disclose the information to the Advertising Standards Authority if required to do so.
  16. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using the prize, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.
  17. The Promoter does not assume any responsibility for bar codes damaged or defaced in the way the product packaging is opened. If you cannot read your promotional barcode due to a genuine printing error, you should contact Nestlé Consumer Services either by email at services@UK.nestle.com or by telephone on Freephone 00800 6378 5385 (UK + ROI). Any request for a replacement barcode must be received by 25.04.22. Only applications received by 20.06.21 will be processed before the end of the core promotional period. Applications received between 21.06.21 – 13.09.21 will be processed before the first late entry draw. Applications received between 14.09.21 – 25.04.22 will be processed before the final late entry draw.
  18. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms & Conditions and the remaining clauses shall survive and remain in full force and effect.
  19. The Promotion and these Terms and Conditions will be governed by the laws of the participating country but any disputes as to the meaning of these terms will be subject to the exclusive jurisdiction of the participant’s local courts.

Data Protection

  1. The Promoter will only use the personal details supplied for the administration of the promotion and the auditing of the entries where necessary and for no other purpose, unless we have your consent/you have opted-in to receive future marketing communications. The surnames and counties of verified winners will be made available as set out in Clause 66 above and winners can object to this by emailing UKI.Dataprotection@uk.nestle.com. Otherwise, your personal details will at all times be kept confidential and in accordance with the General Data Protection Regulation (GDPR) and the Data Protection Act 2018 as applicable. Click here for the Promoter’s Privacy Policy.
