Terms & Conditions

These Terms & Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry / claim instructions are deemed to form part of the Terms & Conditions and by entering this promotion all participants will be deemed to have accepted and be bound by the Terms & Conditions. Please retain a copy for your information.

The Promoter takes data protection seriously. By entering in this promotion, you confirm that you have read the Privacy Policy, and agree to these Terms & Conditions of the promotion. By submitting any information required as part of their participation into the campaign, participants agree to their information being held and processed in accordance with the General Data Protection Regulation (GDPR) and Data Protection Act 2018.

Eligibility
  1. The promotion is open to UK (England, Scotland, Wales and Northern Ireland), Isle of Man, Channel Island and Republic of Ireland residents aged 18+ only and excludes employees and the immediate families of Nestlé UK Ltd (“the Promoter”), its affiliated companies, agents or anyone else professionally connected to the promotion.
  2. Internet access required.
  3. Purchase necessary (No Purchase Necessary in NI). Please retain promotional code and pack as proof of purchase.
  4. Maximum of two (2) prizes (£200 Virgin Experience Days voucher codes) per person only during the promotional period. There is no limit to the number of times a participant may enter, so long as a different unique promotional pack and code is used for each entry. Anyone trying to circumvent this rule by using alternative details will be disqualified from this promotion.
  5. Bulk entries made from trade, consumer groups, agents, third parties or syndicates will not be accepted. If it becomes apparent that a participant is using a computer(s) to circumvent this condition by, for example, the use of programme, application, script, brute force or any other automated means, that person’s claim(s) will be disqualified, and any voucher/allowance awarded will be void.
  6. Conduct of entry: The Promoter reserves the right at its sole discretion to disqualify any entrant found to be tampering with the code redemption process or the operation of the promotion; or to be acting in any manner deemed by the Promoter to be in violation of the Terms & Conditions; or to be acting in any manner deemed by the Promoter to be disruptive.
Promotional Period
  1. The core promotion will run between 9am – 7pm daily 11.05.20 to 05.07.20.
  2. After the core promotional period, there will still be an opportunity to win one of 10 x Virgin Experience Days voucher codes in each of the 3 late entry draws:
    1. The first late entry draw period will run between 00.00 on 06.07.20 and midnight on 02.08.20.
    2. The second late entry draw period will run between 00.00 on 03.08.20 and midnight on 27.09.20.
    3. The third late entry draw period will run between 00.00 on 28.09.20 and midnight on 11.05.21.
  3. Entries, depending on times will be accepted into the relevant promotional draws detailed. Entries are valid for the applicable draw only and will not roll over.
Entry Requirements
  1. To enter for a chance to win a £200 Virgin Experience Days voucher code, participants must:
    1. Purchase a participating promotional pack of Nestlé singles whilst stocks last (see clause 22 for participating products);
    2. Visit www.nestle-promotions.co.uk/days.
    3. Enter full name, email address, county and country of residence and the unique 12-character promotional pack code found inside promotional packs to be entered into a prize draw.
      1. Entrants into the core promotion will be entered into that hour’s prize draw and be notified, by email, within 1 hour if they are a winner.
      2. Entrants into any late entry draws will be entered into their respective prize draw and will be notified, by email, within 2 weeks of the closing date if they are a winner.
    4. All entries received during the core promotional period and the first and second late entry draws (as specified in Clauses 8 and 9 above) will also receive a 20% off Virgin Experience Days unique discount code on the promotional microsite instantly and within a confirmation email sent to the email address they have provided.
  2. Please retain your promotional pack and unique pack code as you may need this for verification purposes.
  3. Unique promotional pack codes can only be used once. Entrants who do not give correct details or those who make an entry on someone else’s behalf will be disqualified.
  4. Incomplete, illegible, misdirected or entries received outside any promotional period will not be accepted. Proof of sending will not be accepted as proof of delivery. The Promoter takes no responsibility for entries delayed, incomplete or lost due to technical reasons or otherwise.
  5. To enter without purchase in Northern Ireland only – send your name, age, full postal address and email address to: Nestlé Virgin Experience Days Promotion NPN, Consumer Services, Nestlé UK Ltd, Haxby Road, York, YO91 1XY. Once the request has been verified, a unique promotional pack code will be provided via email, which can then be entered on the microsite in order to enter the promotion. Only one entry per stamped, correctly mailed envelope. A maximum of 2 entries permitted per person throughout the promotion period. No Purchase Necessary applications must be received by the Promoter no later than 30.04.21. Only applications received by 28.06.20 will be processed before the end of the core promotional period. Applications received by 13.09.20 will be processed before the 20% off discount offer ends.

  6. Virgin Experience Days voucher codes cannot be used in conjunction with any other discount code.

Terms & Conditions for £200 Unique Voucher Codes

  1. Total of 560 x £200 Virgin Experience Days voucher codes to be won between 11.05.20 and 05.07.20. 1 x prize draw per hour between 9am – 7pm daily (10 x winners per day within the core promotional period).
  2. Total of 30 x £200 Virgin Experience voucher codes to be won in 3 x prize draws (10 x winners to be chosen in each):

  9. Experience descriptions, format and timings given on Virgin Experience Days websites and in any other literature are only intended to present a general idea of the experience and shall not be considered binding. In particular, photographs are for illustrative purposes only and do not form part of any contract between you and Virgin Experience Days. Winner selection and notification
  1. All entries received during the core promotional period and the first and second late entry draws (as specified in Clauses 7 and 8 above) will also receive a 20% off Virgin Experience Days unique discount code on the promotional microsite instantly and within a confirmation email sent to the email address they have provided. Entrants can then claim their discount at www.virginexperiencedays.co.uk.
  2. Within the core promotional period, winners only will be notified within 1 hour of the draw closing, via email, to confirm the claim process. There will be a request for further information such as proof of ID and address. Once verified, the consumer will receive a further email containing a unique experience voucher redeemable with Virgin at www.virginexperiencedays.co.uk.
  3. 10 x winners will be drawn in each late entry draw and winners only will be contacted via email within 2 weeks of each of the late entry draw closing dates, following the same process as the core promotional period.
  4. Winners of the prize draw will be randomly selected by a secure, independently verified computer programme.
  5. Winners will be subject to a full verification process. Winners may be asked to provide their promotional pack with the unique code and proof of purchase in order to verify their claim.
  6. Proof of sending is not proof of purchase. Responsibility cannot be accepted for any requested claims that are lost, damaged or delayed, nor any associated costs to entrants.
  7. In the event that any winner is disqualified from the promotion, the Promoter reserves the right to withdraw their prize and include this in the next late entry draw.

General

  2. The Promoter is not responsible for the acts or default of third-party suppliers but will endeavour to resolve any issues that may arise.

  12. Limitations of liability: Neither the Promoter, its agents or anyone professionally connected to the promotion, assume any responsibility or liability for:
    1. Any incorrect or inaccurate code entry, or for any faulty, erroneous or failed electronic data transmissions;
    2. Any unauthorised access to, or theft, destruction or alteration of codes at any point in the operation of this promotion. Communications line failure, regardless of cause, with regards to any equipment, systems, networks, lines, satellites, servers, computers or providers utilised in any aspect of this promotion;
    3. Inaccessibility or unavailability of the internet or the microsite or any combination thereof;
    4. Any unauthorised access to, or theft, destruction or alteration of codes at any point during the operation of this promotion.
  13. Prizes are not transferable or exchangeable unless otherwise stated and cannot be redeemed for cash or any other form of compensation. In the event for any reason the user does not take any element of the prize at the time stipulated by the Promoter, then that element of the prize will be forfeited by the user and neither cash nor any other form of compensation will be supplied in lieu of that element of the prize, unless otherwise agreed. If, due to unforeseen circumstances, the prize is not available, the Promoter reserves the right to substitute another prize for it, in its sole discretion, of equal or higher value. Unless otherwise agreed in writing by the Promoter, the prize will only be awarded directly to the participant.
  14. Conduct of entry: The Promoter reserves the right at its sole discretion to disqualify any entrant found to be tampering with the code redemption process or the operation of the promotion; or to be acting in any manner deemed by the Promoter to be in violation of the Terms and Conditions; or to be acting in any manner deemed by the Promoter to be disruptive.
  15. If, for any reason, any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter may in its sole discretion modify or suspend the promotion or invalidate any affected entries. If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms and Conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation but will always endeavour to minimise the effect to participants in order to avoid undue disappointment.
  16. The Promoter reserves the right to verify all entries including but not limited to asking for address and identity details (which they must provide within 14 calendar days) and to refuse to award a prize or withdraw prize entitlement, and/or refuse further participation in the promotion and disqualify the participant where there are reasonable grounds to believe there has been a breach of these Terms and Conditions or any instructions forming part of this promotion’s entry requirements or otherwise, where a participant has gained unfair advantage in participating in the promotion or won using fraudulent means. The Promoter will be the final arbiter for all decisions, which are final and binding. It will not respond to any correspondence.
  17. By taking part in the promotion, winners agree that Nestlé may contact them to ask whether they want to participate in marketing activities relating to the promotion.
  18. Subject to Nestlé’s Privacy Policy, the surnames and counties of verified winners will be available upon request by sending an email to consumer.services@UK.nestle.com with the subject line 'WINNERS LIST: Virgin Experience Days promotion', for a period of 3 months following the end of the promotion. When contacting this email address, your request will be actioned in line with Nestlé’s Privacy Policy. If any winner objects to their information being published, then they can contact the Promoter by emailing UKI.dataprotection@uk.nestle.com with the subject line 'Virgin Experience Days promotion'.
  19. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using the prize, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.
  20. The Promoter does not assume any responsibility for promotional codes damaged or defaced in the way the product packaging is opened. Any request for a replacement code must be received by 28.06.20 for the core promotional period, 13.09.20 for the 20% off discount code and by 30.04.21 for the final late entry draw.
  21. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms & Conditions and the remaining clauses shall survive and remain in full force and effect.
  22. The Promotion and these Terms & Conditions will be governed by the laws of the participating country but any disputes as to the meaning of these terms will be subject to the exclusive jurisdiction of the participants’ local courts.
Data Protection
  1. The Promoter will only use the personal details supplied for the administration of the promotion and the auditing of the entries where necessary and for no other purpose, unless we have your consent/you have opted-in to receive future marketing communications. The surnames and counties of verified winners will be made available as set out in Clause 80 above and winners can object to this by emailing UKI.Dataprotection@uk.nestle.com. Otherwise, your personal details will at all times be kept confidential and in accordance with the General Data Protection Regulation (GDPR) and the Data Protection Act 2018 as applicable.
