These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry and claim instructions are deemed to form part of the Terms and Conditions and by entering this promotion all participants will be deemed to have accepted and be bound by the Terms and Conditions. Please retain a copy for your information.

The Promoter takes data protection seriously. By entering in this promotion, you confirm that you have read the Privacy Policy, and agree to these Terms and Conditions of the promotion. By submitting any information required as part of their participation into the promotion, participants agree to their information being held and processed in accordance with the General Data Protection Regulation (GDPR) and Data Protection Act 2018.

Eligibility

  1. This promotion is open to United Kingdom (England, Scotland, Wales and Northern Ireland), Isle of Man, Channel Island and Republic of Ireland residents aged 18+ only and excludes employees and the immediate families of Nestlé UK Ltd ("the Promoter"), its affiliated companies, agents or anyone else professionally connected to the promotion.
  2. Internet access required.
  3. Purchase necessary. Please retain promotional pack(s) and all receipt(s) as proof of purchase, showing date of purchase(s) during the Promotional Period and prior to date of entry.
  4. Winners must provide a valid home address to receive their prize.
  5. Maximum 1 entry per person per day and maximum of 1 prize per person and maximum of 1 prize per household. This applies to all periods of the promotion, including the main promotional period (00:00 29.04.24 – 23:59 21.07.24), the first late entry period (00:00 22.07.24 - 23:59 30.11.24) and the 2nd late entry period (00:00 01.12.24 - 23:59 28.04.25).
  6. Entries (bulk or otherwise) made from trade, consumer groups, agents, third parties or syndicates will not be accepted. If it becomes apparent that a participant is using a computer(s) to circumvent this or any other condition by, for example, the use of programme, application, script, brute force or any other automated means, that person's entries will be disqualified, and any prize awarded will be void.
  7. Each entry to the promotion must have a new promotional pack and unique receipt as part of the entry requirements. Anyone trying to circumvent these rules stated in the Terms and Conditions by using alternative details will be disqualified from this promotion.

Promotional Period

  1. Main promotional period: The main promotion is open between 00:00 29.04.24 – 23:59 21.07.24. Entries are permitted between 00:00 and 23:59 each day, for each entry, you must have purchased a new promotional product. There are 400 x prizes allocated by random winning moments available each day.
  2. Late entry periods:
    • Each daily entry submitted between 00:00 22.07.24 – 23:59 30.11.24 will be entered into the 1st late entry period draw.
    • Each daily entry submitted between 00:00 01.12.24 – 23:59 28.04.25 will be entered into the 2nd late entry period draw.
  3. Entries received after the closing date of the 2nd late entry draw will not be accepted into the promotion.
  4. In instances where promotional stock is in the marketplace in advance of the planned promotional start date of 29.04.24, anyone who has purchased a promotional pack ahead of this date still has an opportunity to enter, within the daily limits and conditions as indicated in Clause 5. The Promoter will allow consumers to submit their entries at any point during the main promotional period, as long as they keep their receipt and promotional pack from the date they purchased it.

Entry Requirements

  1. To enter for your chance to win 1 x Aero® Peppermint sharing bar 90g, participants must:
    1. Purchase a participating promotional pack of Aero® (see below for participating products);
    2. Scan the QR code on the back of pack or visit www.aerochocolate.co.uk/win-shaero
    3. Enter your full name, email address and the last 4 digits of the barcode found on the back of the promotional pack.
    4. Winning entrants during the main promotional period will be notified on screen instantly and asked to follow the instructions to claim their prize. Winners will also be sent a confirmation email.
      1. Late Entry Draw 1: All entries received between 00:00 22.07.24 – 23:59 30.11.24 will be entered in the first late entry draw and will be notified, by email, within 14 days of 30.11.2024
      2. Late Entry Draw 2: All entries received between 00:00 01.12.24 – 23:59 28.04.25 will be entered in the first late entry draw and will be notified, by email, within 14 days of 28.04.2025
  2. Each receipt can only be used once. Entrants who do not give correct details, provide inaccurate or the wrong or incorrectly dated receipts or those who make an entry on someone else's behalf will be disqualified.
  3. Incomplete, illegible, misdirected or entries received outside any promotional period will not be accepted. Proof of sending will not be accepted as proof of delivery. The Promotor takes no responsibility for entries delayed, incomplete or lost due to technical reasons or otherwise.

Prize Details

  1. Each prize consists of 1 x Aero® Giant Peppermint Sharing bar 90g.
  2. A total of 34,400 Aero® Giant Peppermint Sharing bars 90g are available to be won:
    33,600 prizes are available to be won instantly online via winning moments (400 prizes per day for 84 days).
    A further 400 prizes are available to be won in the 1st late entry draw (22.07.24 – 30.11.24) and 400 prizes are available to be won in the 2nd late entry draw (01.12.24 – 28.04.25).
  3. No cash alternative will be offered. The prize is non-negotiable, non-transferable and non-refundable in part or in full.

Winner selection and notification

  1. During the main promotional period, the prizes have been randomly allocated and linked to open 'winning moments' that have been randomly pre-selected by a secure independently verified computer programme. There are 33,600 winning moments available throughout the main promotional period, 400 a day for 84 days. The first person to enter their personal details and 4-digit pack code on or after the allocated winning moment will have been deemed to have won the Aero® Peppermint Sharing bar 90g prize. All online instant win prizes will roll over from day to day and week to week, until the end of the promotion and thus are available to be won but no guarantee all prizes will be won. Winners will be notified online immediately after entry and will also be sent a confirmation email. Winners must then follow the on-screen instructions to verify, including confirming their valid home address to claim their prize. A copy of the receipt and image of packaging may also be requested.
  2. Winners must retain their promotional pack containing the barcode and itemised receipt showing date of purchase of participating promotional pack during the Promotional Period and prior to date of entry for each entry as these will be required for verification purposes.
  3. Winners will be subject to a full verification process. If a winner has entered multiple times, the Promoter reserves the right to request receipt proof of all of the entries.
  4. Winning communication should be retained until prize has been verified.
  5. Winners will have 28 days from initial contact to provide their details in order to redeem their prize. If a winner does not follow the instructions either on screen or in the winner information or confirmation email within 28 days of initial contact, or the prize is not claimed or a winner is ineligible, the Promoter reserves the right to disqualify those winners. Any unclaimed prizes from the main promotional period will be rolled into the first late entry draw. Any unclaimed prizes from the first late entry draw will be rolled into the second late entry draw. Any prizes not claimed by the end of the second late entry draw will mean the prize will be declared null and void. Prizes will be reallocated to the prize pool if a winner has previously won or if there is a previous winner within their household.
  6. In the event that any winner is disqualified from the main promotion, the Promoter reserves the right to withdraw the prize and reallocate the prize to the late entry prize pool.
  7. 2 x late entry draws will be conducted from all entries received between 00:00 22.07.24 – 23:59 30.11.24 (1st late entry period) and between 00:00 01.12.24 – 23:59 28.04.25 (2nd late entry period) and 400 winners in each draw (and in addition any unclaimed prizes from the main promotional period or initial late entry draw) will be selected.
  8. The two prize draws will be carried out from all genuine valid entries via an independently verified random computerised draw process within 5 working days of the relevant promotional "late entry" close date.
  9. Winners of the late entry prize draws will be contacted via the email address that they used to enter the promotion within 7 days of each draw date and will be asked to follow the instructions to claim their prize within 14 days by providing their home address (and copy of receipt and image of packaging if requested). In the case that they do not respond in time, reject the prize or are ineligible, the Promotor reserves the right to further contact one (1) reserve to fulfil any prizes not claimed in this instance, with the original winner being withdrawn and the prize forfeited. If this process is not successful in contacting winners or a reserve winner after 2 reasonable attempts to do so, the Promoter reserves the right to withdraw these unclaimed prizes and add to the 2nd late entry draw. For the 2nd late entry draw the same winner and reserve procedure will occur however, any prizes not claimed after this will mean disqualification of that entrant and the prize will be declared null and void. Entrants are encouraged to monitor their email account during these times in case they are a winner.

Prize fulfilment

  1. Once a winner has submitted their details, their home address has been verified and the completion of any further verification process, delivery of the prize will take place within 14 days. Any delay will be communicated to the winner.
  2. The Aero® Giant Peppermint Sharing Bar 90g will be delivered to the home address of the winners via Royal Mail within 14 days following winner verification.
  3. The Promotor is not responsible for any loss or damage to the prize once the item has been dispatched from the fulfilment house.
  4. It is the responsibility of the entrant to provide correct, up-to-date details when entering the promotion and on prize acceptance. Winners must submit their own personal home address details only, therefore cannot send their prize to an alternative address. A winner's address also cannot be amended once verified and submitted, therefore the Promoter is not responsible for incorrect delivery in the event of an error in address or a winner changing addresses between submitting details and their prize being distributed.
  5. By submitting their home address details, winners are accepting responsibility that the product is safe to be delivered to their address and will not be accessible to unmonitored pets in which product consumption could cause harm.

General

  1. The Promoter's decision is final with regard to all promotional matters.
  2. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person's negligence) in connection with this promotion or accepting or using the prize, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.
  3. All entrants will be required to provide a genuine email address and home address that is personal, valid and accessible throughout the promotion. In the event that the specified information is not provided or is incorrect or an alias, the entry may be considered incomplete and therefore the Promoter reserves the right to invalidate the entry.
  4. In the event of an email address becoming inaccessible during the promotion, the Promoter is not able to retrieve and amend any existing entries to a new email address.
  5. Last 4 digits of the barcodes must be entered online exactly as they appear on the pack. Each barcode that is entered on the promotional microsite must be a separate purchase with a corresponding itemised receipt in order for the entry to be valid. Please retain for any prize claim.
  6. Barcodes have no value and cannot be transferred or sold.
  7. In ROI this promotion is carried out under under licence issued by Dundalk District Court and held by Dublin Simon Community, 5 Red Cow Lane, Smithfield, Dublin 7. The purpose of this lottery is to raise funds to help homelessness in Ireland.
  8. Limitations of liability: Neither the Promoter, its agents or anyone professionally connected to the promotion, assume any responsibility or liability for:
    1. Any incorrect or inaccurate entry, or for any faulty, erroneous or failed electronic data transmissions;
    2. Communications line failure, regardless of cause, with regards to any equipment, systems, networks, lines, satellites, servers, computers or providers utilised in any aspect of this promotion;
    3. Inaccessibility or unavailability of the internet or the microsite or any combination thereof;
    4. Any unauthorised access to, or theft, destruction or alteration of barcodes at any point during the operation of this promotion;
    5. Any damage, injury or loss of earnings incurred directly or indirectly in relation to this promotion.
  9. Conduct of entry: The Promoter reserves the right at its sole discretion to disqualify any entrant found to be tampering with the QR code entry process or the operation of the promotion; or to be acting in any manner deemed by the Promoter to be in violation of the Terms & Conditions; or to be acting in any manner deemed by the Promoter to be disruptive.
    If, due to unforeseen circumstances, a prize is not available, the Promoter reserves the right to substitute another prize, for it, in its sole discretion, of equal or higher value. Unless otherwise agreed in writing by the Promoter, the prize will only be awarded directly to the participant.
  10. If, for any reason, any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter may in its sole discretion cancel, modify or suspend the promotion or invalidate any affected entries. If any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions (including but not limited to global or regional health crises, weather conditions, fire, flood, strike, hurricane, industrial dispute, war, terrorist activity, hostilities, political unrest, riots, civil commotion, epidemic, pandemic, famine, plague or other natural calamities and acts of God), the Promoter will not be liable for any failure to perform or delay in performing its obligationsbut will always endeavour to minimise the effect to participants in order to avoid undue disappointment.
  11. The Promoter reserves the right to verify all entries including but not limited to asking for purchase, home address and identity details (passport, driving licence or equivalent) and to refuse to award a prize or withdraw prize entitlement, and/or refuse further participation in the promotion and disqualify the participant where there are reasonable grounds to believe there has been a breach of these Terms and Conditions or any instructions forming part of this promotion's entry requirements or otherwise, where a participant has gained unfair advantage in participating in the promotion or won using fraudulent means. The Promoter will be the final arbiter for all decisions, which are final and binding. It will not respond to any correspondence.
  12. Evidence of surnames and counties of winners will be available at the end of the promotion and the Promoter may disclose this information to the Advertising Standards Authority if required to do so. This same information, subject to Nestle's Privacy Policy, will be available by sending an email request to consumer.services@uk.nestle.com with the subject line 'WINNERS LIST: WIN Aero to ShAero Promotion', for a period of 3 months following the end of main promotional period. When contacting this email address, your request will be actioned in line with Nestlé's Privacy Policy. The Promoter reserves the right to refuse any or all such requests. If any winner objects to their information being published, then they can contact the Promoter by emailing UKI.Dataprotection@uk.nestle.com with the subject line 'Nestlé WIN Aero to ShAero Promotion'.
  13. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.
  14. The Promotion and these Terms and Conditions will be governed by the laws of the participating country and any disputes as to the meaning of these terms will be subject to the exclusive jurisdiction of the participant's local courts.

Data Protection

  1. The Promoter will only use the personal details supplied for the administration of the promotion and the auditing of the entries where necessary and for no other purpose, unless we have your consent/you have opted-in to receive future marketing communications. The surnames and counties of residence of verified winners will be made available as set out in Clause 46 above and winners can object to this by emailing UKI.Dataprotection@uk.nestle.com. Otherwise, your personal details will at all times be kept confidential and in accordance with the General Data Protection Regulation (GDPR) and the Data Protection Act 2018 as applicable. By participating in the promotion, you agree to the use of your personal data as described here. You can withdraw your consent at any time.
